What is the difference between a "T Visa" and a "U Visa"?

T Visa: This visa grants victims the ability to stay and work in the U.S for 3 years. They are then eligible to apply for a green card.

U Visa: This visa is applicable to immigrants who are either victims themselves, or who posses information regarding one of the following forms of criminal activity: rape, torture, trafficking, incest, domestic violence, sexual assault, prostitution, sexual exploitation, female genital mutilation, hostage holding, peonage, involuntary servitude, slave trade, kidnapping, abduction, unlawful criminal restraint, false imprisonment, blackmail, extortion, manslaughter, murder, felonious assault, witness tampering, obstruction of justice, perjury, or attempted conspiracy. This visa also grants victims the ability to stay and work in the U.S for 3 years. They are then eligible to apply for resident status.

To be eligible for Certification, T visas or U visas, victims must:

  • Be present in the U.S or in a U.S territory.
  • Be willing to assist in the investigation and prosecution of the traffickers.
  • Make a bona fide application for a T or U Visa, or have continued presence.
  • Demonstrate that they would suffer extreme hardship if removed from the United States.
